Preferred Tires - Terms and Agreements for Mobile Tire Service
By utilizing the services provided by Preferred Tires, the customer agrees to the following terms and conditions:
1. Service Agreement
Description of Services:
Preferred Tires agrees to provide mobile tire services as requested by the customer, including but not limited to tire installation, repair, rotation, balancing, and roadside assistance.
Scope of Work:
Services will be performed on the vehicle identified by the customer at the agreed-upon location. Any additional services requested outside of the initial agreement will require a separate authorization and may incur additional charges. Unforeseen issues, such as damage to a wheel during tire removal or non-standard tire requirements, may also result in additional charges, which will be discussed with the customer before proceeding.
Customer Responsibility for Information:
The customer is responsible for providing accurate and complete information regarding their vehicle, tire size, and any existing issues. This includes informing Preferred Tires of any modifications or aftermarket parts (e.g., custom rims, lift kits, etc.). Preferred Tires is not liable for errors or delays resulting from inaccurate or incomplete information provided by the customer.
2. Pricing and Payment
Quoted Price:
The customer will be provided with a quote for services prior to commencement of work. This quote is an estimate and may be subject to change if unforeseen issues arise or additional services are requested. In the event that additional charges are incurred, Preferred Tires will obtain approval from the customer before proceeding.
Payment Due Upon Completion:
Payment for all services and products is due in full upon completion of the work, unless alternative arrangements have been made in advance and in writing.
Accepted Payment Methods:
[List accepted payment methods, e.g., Cash, Credit/Debit Card (Visa, MasterCard, American Express, Discover), Mobile Payment Apps (e.g., Apple Pay, Google Pay)].
Late Payment/Bounced Checks:
A late fee of per month or [$50] will be applied to overdue balances. A fee of [$50] will be charged for any returned checks. For overdue balances, Preferred Tires reserves the right to suspend future services until full payment is made.
Deposits:
A non-refundable deposit of [50]% may be required for special order tires or extensive services. This deposit is applicable for [specific conditions, e.g., custom orders, high-value tires].
3. Customer Responsibilities and Vehicle Condition
Vehicle Access and Safety:
The customer must ensure a safe and accessible location for Preferred Tires to perform services. This includes providing adequate space, ensuring the vehicle is on a stable surface, and securing any pets or obstacles.
Valuables:
The customer is responsible for removing any valuables from their vehicle before services begin. Preferred Tires is not responsible for lost or damaged personal items.
Pre-existing Conditions:
Preferred Tires is not responsible for damage to the vehicle or its components resulting from pre-existing conditions (e.g., rusted lug nuts, stripped studs, damaged wheels, faulty TPMS sensors) or issues not directly related to the services performed. The customer is responsible for informing Preferred Tires of any visible damage or issues with the tires, rims, or suspension components before work begins.
Notification of Issues:
The customer agrees to inform Preferred Tires of any concerns or issues with the service promptly upon completion. Customers must notify Preferred Tires of any issues regarding service quality or vehicle condition within [48 hours] of completion. After this period, Preferred Tires is not liable for any post-service issues.
4. Warranty and Disclaimers
Workmanship Warranty:
Preferred Tires warrants its workmanship for a period of [e.g., 30 days] from the date of service. This warranty covers defects in the labor performed.
Tire Manufacturer Warranty:
New tires sold and installed by Preferred Tires are covered by the respective tire manufacturer's warranty. Preferred Tires is not the warrantor of the tires themselves but will assist the customer in facilitating warranty claims with the manufacturer where applicable.
Exclusions from Warranty:
This warranty does not cover damage caused by:
Road hazards (e.g., nails, glass, potholes)
Improper vehicle maintenance by the customer (e.g., incorrect tire pressure, misalignment)
Off-road use or racing
Accidents, vandalism, or theft
Misuse, abuse, or negligence
Tire repairs performed by others
Used Tires Disclaimer:
Used tires are sold as-is with no warranty, express or implied, regarding their condition, suitability for a particular purpose, or longevity. The customer assumes all risks associated with the use of used tires. If a used tire fails within [50] miles of installation, Preferred Tires will assist the customer in determining the cause, but the customer is responsible for any replacement costs.
Limitation of Liability:
In no event shall Preferred Tires be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of use, or damage to property, arising from or related to the services performed, even if Preferred Tires has been advised of the possibility of such damages. Preferred Tires' total liability for any claim arising out of or relating to these terms or the services shall not exceed the amount paid by the customer for the services giving rise to the claim.
5. Vehicle Operation and Safety After Service
Post-Service Check:
The customer is advised to drive cautiously and check tire pressure, lug nut torque, and general vehicle performance immediately after services are completed and again after [e.g., 50] miles. Preferred Tires recommends re-torquing the lug nuts after [50] miles of driving. Re-torquing will be provided free of charge within [e.g., 15 days or 50 miles].
Lug Nut Torque:
While lug nuts are torqued to manufacturer specifications, changes in temperature and driving conditions can affect torque. The customer is encouraged to re-torque lug nuts after [50-100] miles of driving. Preferred Tires offers a free re-torque service within [e.g., 15 days or 50 miles].
TPMS (Tire Pressure Monitoring System):
While care is taken with TPMS sensors, Preferred Tires is not responsible for pre-existing sensor malfunctions or sensor failure during tire service, as sensors can be brittle. Replacement sensors are available at an additional charge. The customer should check for TPMS warnings immediately after service and report any issues promptly.
6. Consent to Service
By allowing Preferred Tires to commence work on their vehicle, the customer acknowledges and agrees to these terms and conditions. The customer confirms their understanding of these terms either via digital acknowledgment or written consent.
7. Governing Law and Dispute Resolution
Governing Law:
These terms and conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Dispute Resolution:
Any dispute arising out of or relating to these terms or the services provided shall first be attempted to be resolved through good-faith negotiations between the parties. If an amicable resolution cannot be reached, the parties agree to submit the dispute to mediation before an agreed-upon mediator in Apple Valley, California . If mediation fails, the dispute will proceed to binding arbitration under the laws of the State of California.
8. Severability
If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. If any provision is found to be partially unenforceable, the remainder of the provision shall be enforceable.
9. Entire Agreement
These terms and conditions constitute the entire agreement between the customer and Preferred Tires concerning the services provided and supersede all prior or contemporaneous communications, understandings, and agreements, whether oral or written.
10. Force Majeure
Preferred Tires shall not be held liable for delays or failure to perform services due to unforeseen events beyond its control, including but not limited to natural disasters, extreme weather, accidents, or government restrictions.
